Attorney General John M. Formella announces that Caitlin Nieder, age 33, of Concord, New Hampshire, has been convicted and sentenced in the 6th Circuit — District Division — Concord Court for diverting prescription medication while employed by a long-term care facility in Epsom. On May 25, 2024, a nurse working for Epsom Healthcare Center noticed medication cards containing prescription medication intended for two patients had been tampered with during a routine medication count. Epsom Healthcare Center investigated the issue and Nieder, who was employed as a nurse at the facility at that time, admitted to taking the medications and replacing them with melatonin. There is no indication any patients at Epsom Healthcare Center were administered the altered medication. Epsom Healthcare Center promptly notified the Epsom Police Department, which conducted a full investigation. During that investigation Nieder admitted taking the medication.
Nieder pleaded guilty to a single class A misdemeanor charge of Possession of a Prescription Drug Without a Prescription. The Court sentenced her to 12 months at the Merrimack County House of Corrections and a $350.00 fine plus statutory penalty assessment. The sentence and fine were fully suspended for a period of five years on the condition that Nieder remain of good behavior and comply with the terms of the sentence. The terms of the suspended sentence include the voluntary surrender of Nieder’s nursing license for a period of five years and continued participation in treatment.
